LIMITED ONE (1) YEAR WARRANTY
Your Pixy and official Pixy-branded accessories, including the Rechargeable Battery for Pixy and Dual Battery Charger for Pixy (each, a “Product”) are covered by a limited one (1) year warranty. By using Pixy and official Pixy accessories, you are agreeing to be bound by the terms of this Limited Warranty (the “Warranty”) as set out below.
WHO IS THIS WARRANTY FROM?
Snap Inc., of 3000 31st Street, Santa Monica, CA 90405, USA (“Snap”) issues this Warranty for Products purchased in the United States.
HOW LONG DOES WARRANTY COVERAGE LAST?
Snap warrants the Products against faulty materials or workmanship in the hardware that comprises your Product for a period of 12 months from the date of original retail purchase of each separate Product (the “Warranty Period”).
WHAT DOES THIS WARRANTY COVER?
This Warranty covers faulty materials or workmanship in the hardware that comprises your Product. Specifically, Snap warrants that the hardware will be free from manufacturing defects and, under normal and intended use (in line with Snap’s user manuals and safety instructions), will function substantially in accordance with our product documentation during the Warranty Period.
WHAT WILL WE DO?
If your Product is defective or malfunctioning during the Warranty Period, Snap will repair or replace your Product at Snap’s sole discretion. Snap warrants that the replacement Product will be free of faulty materials or workmanship for the remainder of the original warranty period for the defective Product or 60 days after you receive the replacement Product, whichever is later. The replacement Product will become your property and the replaced item becomes Snap’s property.
HOW TO OBTAIN WARRANTY SERVICE?
First, tell Snap’s Customer Service team about the problem. Please visit us at support.pixy.com to request Warranty service during your Product’s Warranty Period. Prior to providing Warranty service, we or our agents may require you to provide proof of purchase details (such as a receipt or sales invoice) to determine eligibility.
Second, you’ll need to return the Product to us, at our cost, using shipping instructions that we will provide you once you have reached out to us. Once we receive the Product, we’ll determine if it has a defect or malfunction, is within the applicable Warranty Period, and is otherwise covered by this Warranty. If so, we’ll send the replacement Product to you at our cost. Please note that we are only able to provide this service in countries where pixy.com ships.
Note that if you are sending in a Pixy, we won’t transfer any content from a returned Pixy to a replacement Pixy. You should remove and separately store any such content before returning your Pixy; Snap and its agents are not responsible for any loss of content contained on your Pixy, and will be unable to recover any content or other information contained in a Pixy once it has been returned.
WHAT DOES THIS WARRANTY NOT COVER?
This Warranty does not cover the following:
- Damage resulting from accidents, or from normal wear and tear;
- Damage resulting from improper storage, misuse or abuse, neglect including scratches, cracks, or surface damage, or exposure to extreme conditions including extreme heat, dirt, or sand. “Misuse” includes without limitation use in a manner or environment not in compliance with the recommendations in this document, our online user manual, safety instructions, or other related documentation;
- Damage resulting from use in other improper conditions, including but not limited to conditions described in the Pixy safety instructions;
- Normal depletion of consumable parts such as batteries, unless occurring due to a defect in original materials or workmanship. As an example, only batteries that exhibit fully charged capacity below 80% of the actual rated capacity or batteries that leak during the Warranty Period will be considered defective for purposes of the Warranty;
- Products that have been physically or electronically altered, modified, undergone unauthorized repairs, or exhibit third-party software changes;
- Software or firmware embedded in or distributed with Pixy. We do not warrant that such software or firmware will operate without error, that it will be compatible with any third-party hardware or software, or that content captured or distributed through your Pixy will not be lost or corrupted.
LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. SNAP DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, SNAP LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT SNAP’S OPTION, THE REPLACEMENT REMEDIES DESCRIBED ABOVE.
This Warranty gives you specific legal rights, and you may also have other rights, which vary from state to state. Some states and countries do not allow the exclusion or limitation of incidental or consequential damages, so limitations or exclusions in this warranty may not apply to you.
WE DO NOT, UNDER THIS WARRANTY, ASSUME ANY LIABILITY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, MULTIPLE, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR REVENUES, LOSS OF DATA, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT, COST OF ANY REPLACEMENT GOODS OR SUBSTITUTE EQUIPMENT, OR LOSS OF USE DURING THE PERIOD THE PRODUCT IS BEING REPLACED OR REPAIRED. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, IN THE EVENT OF A PRODUCT REPLACEMENT, WE ARE NOT LIABLE FOR ANY ASSOCIATED DATA LOSS OR CONSEQUENTIAL DAMAGES OF ANY KIND.
FURTHER, TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ASSUME NO LIABILITY FOR ANY ACCIDENT, INJURY, DEATH, LOSS, OR OTHER CLAIM RELATED TO , ARISING OUT OF, OR OTHERWISE RESULTING FROM THE PRODUCTS. WE SPECIFICALLY ADVISE YOU AGAINST USING PRODUCTS IN A MANNER INCONSISTENT WITH THIS WARRANTY, OUR WARNINGS, OUR COMPATIBILITY PAGE, AND OTHER ACCOMPANYING DOCUMENTATION. IN NO EVENT WILL OUR LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS WARRANTY STATEMENT EXCEED THE PRODUCT PURCHASE PRICE PAID BY YOU.
The disclaimers and limitations of liability above do not limit your rights under applicable local or national law, and do not apply to the extent liability cannot be disclaimed under applicable law, including without limitation applicable product liability and consumer protection statutes. If any term herein is held to be illegal or unenforceable under applicable law, such term shall be severed from this Warranty and to the extent legally permitted, the remaining terms shall not be affected.
PRODUCTS NOT ELIGIBLE UNDER THE LIMITED WARRANTY
